Last updated: 24 de maio de 2026 / May 24, 2026
Reading and agreeing to these Terms of Service ("Terms") is mandatory for registering and using the services offered by App Mestre ("Platform" or "Provider"), operated by App Mestre Tecnologia — Brazilian Company Registration (CNPJ) 48.844.509/0001-47. Registration via the administration panel constitutes irrevocable acceptance of the conditions set forth herein.
1. Nature of Service and Platform's Role
App Mestre acts strictly as a Software as a Service (SaaS) technology and infrastructure provider. We offer tools for creating and managing applications (Web and Native) for Content Producers ("Creators").
⚠ Disclaimer of Liability for Third-Party Content
App Mestre does not create, promote, review, or endorse the digital products, services, courses, or claims made by Creators using our infrastructure. All content generated by Creators or Students is the sole responsibility of its respective authors. App Mestre claims the protections of Section 230 of the Communications Decency Act (US), Article 19 of Brazil's Internet Act (Lei 12.965/2014), and the intermediary liability provisions of the EU Digital Services Act (Regulation (EU) 2022/2065).
2. Acceptance and Eligibility
By accessing or using the Platform, you represent that: (a) you are of legal age and at least 18 years old; (b) the information provided upon registration is truthful, complete, and current; (c) you are authorized to bind the legal entity you represent, if applicable; (d) you are not prohibited by law from receiving the services; (e) your account has not been previously suspended or terminated for violation of these Terms.
3. Account Registration
The Creator is responsible for maintaining the confidentiality of their access credentials and for all activities occurring under their account. App Mestre is not responsible for unauthorized access resulting from user negligence. Using another person's name, email, or data without authorization is expressly prohibited.
4. Services, Plans, and Availability
App Mestre offers different subscription plans ("Plans"), whose features, limits, and prices are described on the current pricing page. We reserve the right to: (a) modify features with 30 days' prior notice; (b) discontinue features with 90 days' prior notice; (c) perform scheduled maintenance with at least 24 hours' advance notice. Target availability SLA is 99.5% per month, excluding force majeure events and scheduled maintenance.
5. Payments and Billing
Plan fees are charged in advance on a recurring basis (monthly or annual). Non-payment within 7 calendar days after the due date will result in service suspension and, after 30 days, account cancellation and data deletion. Prices may be adjusted with 30 days' prior notice. The Creator is responsible for all applicable taxes in their jurisdiction.
For EU users, displayed prices include VAT where applicable. The EU right of withdrawal (Directive 2011/83/EU) applies to consumer contracts, as detailed in our Refund Policy.
For UK users, the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013 apply where applicable.
For US users, by providing a payment method, you authorize us to charge the applicable fees. Auto-renewal applies unless cancelled prior to the renewal date.
6. Intellectual Property
App Mestre and all Platform elements (software, design, code, trademarks, logos, texts) are protected under applicable intellectual property laws, including the US Digital Millennium Copyright Act (DMCA), EU Copyright Directive (2019/790/EU), and Brazilian Copyright Act (Lei 9.610/1998). You may not copy, modify, decompile, reverse-engineer, sublicense, or redistribute any part of the Platform without express written authorization.
The Creator grants App Mestre a limited, non-exclusive, royalty-free license to host, store, reproduce, and display their content solely for the purpose of providing the contracted services.
7. Prohibited Conduct
You expressly agree not to use the Platform to: (a) distribute illegal, obscene, defamatory, discriminatory, or violence-inciting content; (b) engage in spam, phishing, or malware distribution; (c) infringe third-party intellectual property rights; (d) engage in unfair competition or misappropriation of trade secrets; (e) perform unauthorized scraping, crawling, or automated access; (f) attempt to compromise Platform security or availability; (g) facilitate any illegal activities under applicable law in any jurisdiction.
8. Personal Data — LGPD / GDPR / CCPA / UK GDPR
The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms. App Mestre acts as a Data Processor (LGPD Art. 5, VII / GDPR Art. 4(8)) for Student data — processing it under the instruction of Creators, who are Data Controllers. For California residents, please review our CCPA disclosures within the Privacy Policy.
9. Limitation of Liability
To the maximum extent permitted by applicable law, App Mestre shall not be liable for: (a) indirect, incidental, special, consequential, or punitive damages; (b) loss of profits, revenue, data, or goodwill; (c) failures of third parties (payment processors, cloud providers, CDNs); (d) content published by Creators or Students; (e) service interruptions caused by force majeure events. App Mestre's total liability, in any event, is limited to the amounts paid by the Creator in the last 3 months.
For EU/UK consumers: nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any liability that cannot be excluded by law, including consumer protection rights under applicable law.
10. Termination
The Creator may cancel their account at any time via the control panel, without penalty. Cancellation takes effect at the end of the current paid period. App Mestre may terminate or suspend access immediately, without prior notice, in case of: material violation of these Terms, illegal activity, or risk of harm to the Platform or third parties. Following termination, Creator data will be retained for 30 days for possible export and then deleted, subject to legal retention obligations.
11. Amendments to Terms
App Mestre may modify these Terms at any time. Material changes will be communicated with at least 30 days' advance notice via email and panel notification. Continued use of the Platform after the effective date of changes constitutes acceptance of the new conditions. For EU consumer users, changes that negatively affect consumer rights will be communicated with a minimum of 15 days' notice.
12. Governing Law, Jurisdiction, and Dispute Resolution
These Terms are governed by the laws of the Federative Republic of Brazil. For Brazilian users: the courts of Florianópolis, State of Santa Catarina, Brazil, shall have exclusive jurisdiction. For international users: any disputes shall be resolved by international arbitration under the Rules of the International Chamber of Commerce (ICC), seated in Paris, France, conducted in Portuguese or English.
For EU consumers: The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
For UK consumers: You may also contact the UK's Alternative Dispute Resolution (ADR) bodies.
13. General Provisions
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force. App Mestre's failure to exercise any right provided in these Terms shall not constitute a waiver. These Terms constitute the entire agreement between the parties regarding their subject matter and supersede all prior agreements.
